Worried about financial issues after the breakdown of a marriage?

Following the breakdown of a marriage or a civil partnership, there are often financial issues arising which need to be considered. Because each case is different, the Court has a wide discretion when it comes to approving any financial agreement or having to make an order if no agreement has been possible.

Certain factors, including whether any children are involved, will always be taken into account by the Court. Children are an overriding consideration when it comes to considering housing and income needs.

Justine Soper of JLS Solicitors has achieved membership of the Advanced Family Law Panel of the Law Society and Specialist Accreditation with Resolution due to her extensive experience of dealing with financial issues arising from divorce.

If you are struggling with your finances, you may be entitled to Legal Aid. To find out more about financial issues, click here or contact us directly.

An Introduction to Financial Settlements and Pensions

Pensions are often an integral part of financial settlements, but must be considered in a different way to most other capital assets that may be available to a couple. This is because although the pension fund is valued, the reality is that you can never "cash in" that fund and physically get that amount of money in your hand. Also, the pension fund is a future foreseeable asset - a return on the investment will only be seen on retirement, usually around the age of 65.
